At Karns & Kerrison, we're always looking for ways to help our clients. Since we first established our firm in 1974, our attorneys have been serving individuals and families who need legal guidance, representation, and steadfast support.

Recently, Attorney Jude Kerrison went above and beyond to help a client who wasn't sure what to do when she received a low settlement offer from her insurer. Thankfully, with Attorney Kerrison's help, she was able to secure generous weekly benefits and a substantially larger settlement to help her get back on her feet after her ordeal.

Case Details

In 2018, a workers' compensation claimant contacted our office and met with Attorney Jude Kerrison to discuss an offer of settlement that she had received from her employer's workers' compensation insurer. This woman injured her shoulder when she fell down some stairs at work, and a few days later she suffered a stroke.

She had surgery on her shoulder but continued to have problems with her arm, related to her shoulder injury, and she suffered from other symptoms related to her stroke. The insurer offered her $60,000 to settle her case and refused to accept liability for her stroke.

During Attorney Kerrison's meeting with the injured woman, he explained what the offer from the insurer represented and the potential consequences of settling the case. He went on to offer his opinion – which was that the offer from the insurer was too low and it was far too early to consider settling her case.

Attorney Kerrison promised that when it was an appropriate time to settle her case, he could do much better than $60,000. To prove this, Attorney Kerrison volunteered to adjust his fee agreement so that he would not take a contingent fee on the first $60,000 of any settlement that they reached because the client had already secured an offer for that amount by herself without retaining an attorney.

Now, a year and a half later, after the client received another $57,000 in weekly benefits and payment for the permanent impairment in her shoulder, Attorney Kerrison settled the client's workers' compensation case for $479,075.12.

Of course, Attorney Kerrison honored their original agreement and took a reduced attorney fee, happily telling the client, “I told you I'd do better than $60,000.”
