Attorney Jude Kerrison Wins $140,000 in Contested Workers’ Comp Case

The Settlement Covers Shoulder and Neck Injuries, Among Other Complaints

Most employers are required to carry workers' compensation insurance, but knowing where to file your case is not the same as receiving a successful settlement. One of our clients, a Certified Nursing Assistant (CNA), learned this when she injured her shoulder on the job at a nursing home. The insurance company denied her claim, and she came to Karns & Kerrison for help.

Attorney Jude Kerrison won her case at a pre-trial conference, but her troubles were not over. When her shoulder pain did not respond to treatment, her doctors found it was actually a symptom of a neck injury. Though the insurance adjusters had agreed to pay for the shoulder pain, they contested her claim for additional compensation to help with the neck injury behind it. Once again, Attorney Kerrison took her insurer to court, and once again, he succeeded in proving his client's case.

In the end, our client collected workers' compensation checks for 3 years while she underwent neck and shoulder surgery. Attorney Kerrison also succeeded in winning $17,000 for permanent scars from the surgeries and additional compensation when it became clear her shoulder would remain somewhat injured for the rest of her life. All told, the client received over $140,000 which does not include the medical bills the insurance company had to pay.

When bringing a workers' compensation claim, you may need an experienced attorney on your side to help with unfair denials like those our client faced. Even with this relatively small case (catastrophic injuries may lead to settlements in the millions), Attorney Kerrison had to file 12 petitions to help the client receive compensation for her surgeries, missed work, and other damages.
