Pedestrian - Wrongful Death
Here is a case that occurred in Kentucky involving the wrongful death of a young boy. Although Karns & Kerrison was not involved, we thought it was interesting enough to share with our readers.
An electric company that failed to repair a street light owed a duty of care to a pedestrian who was struck by a car while crossing a nearby intersection, the Kentucky Court of Appeals has ruled.
The suit was brought by the father of a 10-year-old who was killed by a car while crossing a highway. The father, claiming that the nearby street light had been inoperable for nearly two months, sought to hold the electric company liable for negligence.
The court allowed the case to go forward indicating the electrical company owed the pedestrian a duty of care.
